3.2.1 Training and Development Services

Professional Training and Development of Panellists, Parties and Trade Unions 3.2.1.1Dispute Resolution Practitioners Professional Development The Council had six training sessions for dispute resolution practitioners as follows:

1. Gauteng and North West - 10 August 2023 2. Mpumalanga & Limpopo - 11 August 2023 3. KwaZulu-Natal - 14 to 15 November 2023 4. Eastern Cape - 17 to 18 October 2023 5. Western Cape - 4 to 5 March 2024 6. Northern Cape – 13 to 14 March 2024

The training was based on the Law of Evidence, amendments to the ELRC constitution, and Pre-Arbitration.

There was also training of dispute resolution practitioners by ITCILO on lanaging Labour disputes effectively in the workplace and conciliation and mediation of labour disputes (27 September 2023 to 6 October 2023).

3.2.1.2 Panellist Professional Development The Council had four training sessions for panellists as follows:

• KwaZulu-Natal - 16 to 17 November 2023 • Eastern Cape - 11 to 12 December 2023 • Gauteng – 13 to 14 March 2024 • Online - 19 March 2024

The training covered the following areas of Law: • Conciliating Education matters • Settlement Agreement • Awards and Rulings • Recusals • Jurisdiction • Interpretation of Collective Agreements • Deemed Dismissals • Subpoenas • Dealing with Consistency in Misconduct • Dealing with Hearsay Evidence in Cases Involving Minors • Compensation and Backpay in Unfair Dismissals • Damages Arising out of Sexual Assault cases • Guidelines on ULP-Promotion cases • PILIR cases • Amendments to the ELRC constitution
