3.16 COMPLIANCE WITH LAWS AND REGULATIONS

The Compliance Maturity of the MHSC is still at developmental stages where compliance is monitored on an Adhoc basis. The maturity was hampered by the inadequate capacity with the Governance, Risk and Compliance Unit (GRC).

3.17 FRAUD AND CORRUPTION

The MHSC Fraud Prevention Plan and Strategy were reviewed and approved during the financial year. Prevalence of fraud has been low and management has continued with the plan as approved. A survey was conducted during the financial year, which indicated a need for training and education around training on Compliance and the training on Ethics has been included in the MHSC Social and Ethics Implementation Plan 2020/21 , when the MHSC will be embarking on establishing the Social and Ethics Committee. The MHSC Fraud Hotline is managed by Deloitte. The Hotline is a 24-hour system, which is available through various platforms such as email, fax, telephone, etc. Reports are distributed to relevant officials within the MHSC and the relevant Governance structures in terms of the Whistle Blowing Guidelines. Employees are encouraged to make confidential disclosure about suspected fraud and corruption on utilising any of the platforms they are comfortable with. Cases are reported to the relevant Governance Structures as and when they are received. The decision on the format the investigations will take are also determined by the Governance structures.

3.18 MINIMISING CONFLICT OF INTEREST

MHSC officials sign an annual declaration of interest for any business, commercial and financial interests or activities undertaken for financial gain that may raise a possible conflict of interest. Furthermore, SCM officials together with the appointed members of the Bid Committees sign a Code of Conduct for Supply Chain Management Practitioners.. Training of Bid committees is conducted annually in line with National Treasury Regulations. All Bid Committee members sign a Declaration of Interest Form for each bid going through the Committees. Where Conflict of Interest has been identified, each member/official will declare and will be recused from participating in the meeting where a particular bid is discussed.

3.19 CODE OF CONDUCT

The MHSC has and maintains a Code of Conduct that sets rules outlining norms, responsibilities and proper practive with in the MHSC. For further enhancement to the code, during the financial year the MHSC embarked on the process to implement the Social and Ethics Committee with the aim of improving matters of social and ethics. The process will be completed during the first quarter of the next financial year.
