16. B-BBEE COMPLIANCE PERFORMANCE INFORMATION

The following table has been completed in accordance with the compliance to the BBBEE requirements of the BBBEE Act of 2013 and as determined by the Department of Trade and Industry.

Has the Entity applied any relevant Code of Good Practice (B-BBEE Certificate Levels 1 – 8) with regards to the following:

Discussion ( include a discussion on your response and indicate what measures have been taken to comply ) The Entity has in line with section 10 of the BBBEE Act, required Licensees to comply with the BBBEE levels set in the licence conditions of respective Licensees. Licensees have substantially complied with the set licence conditions. Remedial actions have been instituted on Licensees that have not complied with the set BBBEE licence conditions. Although the Entity does not develop the preferential procurement policy, The Entity implements the Preferential Procurement Policy Framework Act as developed by the National Treasury. The Entity used the said Act in assessing the functionality of a potential service provider and in evaluating bids/ quotations for pricing and BBBEE status level. The Act assists in ensuring that the correct/ appropriate service providers are given preference as per the Act. The implementation of the said Act was stopped after a court judgement between Afribusiness and National Treasury on the 16 th of February 2022. The Entity has since not applied the said policy until the 31 st of March 2022.
