Introduction

4.1

The Limpopo Gambling Board was established in terms of Section 2 of the Limpopo Gambling Act, Act No. 4 of 1996, as amended and retained in terms of section 3 of the Limpopo Gambling Act, Act No. 3 of 2013 (hereinafter referred to as “The Act”).

Section 3 of the Act governs the powers and functions of the Entity and it states as follows:

a)

The Board shall: i.

exercise such powers and perform such functions-  assigned to it in terms of this Act;  assigned to it in terms of any other Act;

ii. a dvise the responsible Member or furnish a report or recommendations to the responsible Member on any matter referred to the Board by the responsible Member for consideration or arising from the application of this Act relating to the control over gambling and racing in the Province. b) The Board may, with the approval of the responsible Member and if an Act of any other Province provide therefore, exercise such powers and perform such functions and duties in terms of such Act in respect of persons and matters in the said Province as the Board may in terms of this Act exercise and perform in this Province. c) The Board may, notwithstanding anything to the contrary in another Act contained; pay a reward to any person who has furnished information relating to an alleged contravention of a provision of this Act. d) Notwithstanding anything to the contrary contained in this Act, the responsible Member may, in the absence of a Board, exercise and perform the powers and functions of the Board, excluding the granting and revocation of licences.
