National Environmental Management Act, 1998 (NEMA, Act 107 of 1998, as amended by Act 8 of 2004) a. NEMA (1998, as amended by Act 8 of 2004) The Act provides for co-operative environmental governance by establishing principles for decision-making on matters affecting the environment, institutions that will promote co-operative governance, and procedures for co-ordinating environmental functions exercised by organs of State. The Act further provides for the prohibition, restriction, or control of activities which are likely to have a detrimental effect on the environment, and to provide for matters connected therewith. b. NEMA (Act 8 of 2004) The Act amends the NEMA (1998), to insert certain definitions and substitute others, to make further provision regarding environmental authorisations, to make certain textual alterations, and to provide for the registration of associations of environmental assessment practitioners. The various pieces of legislation regulating the employment of public servants include, but are not limited to the following: • Public Service Act, 1994 • Public Service Regulations, 2001 • Public Service Laws Amendment Act, 1997 and 1998 • Skills Development Act, 1998 • Public Service Co-ordinating Bargaining Council (PSCBC) • General Public Service Sectoral Bargaining Council (GPSSBC) 7.7 P ROVINCIAL POLICIES IMPACTING ON THE SCOPE OF WORK OF THE DEPARTMENT OF INFRASTRUCTURE DEVELOPMENT There are several strategic policy documents that have an impact and influence on the mandate and direction of the service delivery programme of the DID. These include, but are not limited to the following: • Municipal Integrated Development Plans (MIDPs) for the various metros, districts, and local municipalities • Gauteng Provincial Growth and Development Strategy (GPGDS) • Gauteng Strategic Procurement Framework (GSPF) • Gauteng Master Skills Plan (GMSP) • National Development Plan 2030 (NDP) 7.6 LEGISLATION REGULATING THE EMPLOYMENT OF PUBLIC SERVANTS
